    FACEBOOK and INSTAGRAM "ADVENT GAME" CONTEST RULES

    ARTICLE 1 - GAME ORGANIZATION

    Cave du Roi Dagobert - Union Alliance Alsace, a company with capital of 485,000 euros, headquartered at 16 rue des Tuileries 68230 TURCKHEIM, registered with the RCS COLMAR TI 789 359 254 (2012 D 428), is organizing a free, no-obligation game entitled "Advent Game" (hereinafter referred to as "the Game") from December 1 to 24, 2023 inclusive, in accordance with the terms and conditions described in these rules.

    This game is organized as a draw contest.

    This operation is neither organized nor sponsored by Facebook, Google, Twitter, Apple or Microsoft. The personal data collected in the context of this Game is intended for the organizing company and not for Facebook, Google, Twitter, Apple or Microsoft.

    ARTICLE 2 - CONDITIONS OF PARTICIPATION

    This free game is open to all natural persons of legal age with Internet access and a valid e-mail address, residing in mainland France, with the exception of employees of the organizing company and their families, as well as all persons involved in the preparation of the game.

    Participation in this Game implies unreserved acceptance of these rules.

    ARTICLE 3 - TERMS OF PARTICIPATION

    This game is a prize-draw type contest that takes place exclusively on the Internet via the Cave du Roi Dagobert Facebook and Instagram pages: https://www.facebook.com/caveduroidagobert
    and https://www.instagram.com/caveduroidagobert/ on the dates indicated in Article 1.

    Participation in the Game is as follows:
    - the person must give the correct answer to the question of the day.

    Only one entry per person per day - same last name, same first name, same e-mail address - is permitted on Facebook and Instagram throughout the entire contest period.

    As the Game is accessible only on the Facebook, www.facebook.com, and Instagram platforms, www.instagram.com under no circumstances will Facebook or Instagram be held responsible in the event of a dispute related to the Game. Facebook and Instagram are neither organizers nor sponsors of the operation. The personal data collected during the Contest is intended for the organizing company in accordance with Article 12 of these rules.

    ARTICLE 4 - DESIGNATION OF WINNERS

    1 winner will be drawn at random from the correct answers at the end of each play period.
    Play period No. 1: Friday, December 1 to Sunday, December 3. Draw on Monday or Tuesday.
    Playing period N° 2: Monday December 4 to Sunday December 10. Draw on Monday or Tuesday.
    Playing period No. 3: Monday, December 11 to Sunday, December 17. Draw on Monday or Tuesday.
    Playing period No. 4: Monday December 18 to Sunday December 24. Draw on Thursday December 28.

    Each winner will be contacted directly via Facebook messenger, messenger, or by Instagram by the Company within 5 days after the draw. The prize is to be collected directly from the sales outlet in Traenheim, during the cellar's opening hours. If the person is unable to collect the prize, a voucher for the value of the prize will be awarded in the form of a voucher to be redeemed on the Cave du Roi Dagobert online store, within 6 months.

    ARTICLE 5 - PRIZES

    The Game is endowed with the following prizes, awarded chronologically to valid participants drawn at random and declared winners. Each winner receives a single prize.

    Batch composition:

    • Period N°1: 1 box of Gewurztraminer Vieilles Vignes, or a €63.30 voucher to be redeemed in the online store until May 31, 2024.
    • Game Period N°2: 1 case of Irmine, or a €72.00 voucher to be redeemed in the online store until May 31, 2024.
    • Game Period N°3: 1 box of organic Pinot Noir, or a €56.40 voucher to be redeemed in the online store until May 31, 2024.
    • Game Period N°4: 1 case of Crémant Dagobert Prestige, or a €51.60 voucher to be redeemed in the online store until May 31, 2024.

    The organizing company reserves the right to verify the age of any winner before awarding the prize. Under no circumstances may prizes be exchanged for their cash value or for any other prize. The organizing company cannot be held responsible for the use or non-use, or even trading, of the prizes by the winners.

    In the event of force majeure, the organizing company reserves the right to cancel the winning prizes without compensation.

    ARTICLE 6 - IDENTIFICATION OF WINNERS AND ELIMINATION OF ENTRIES

    Participants authorize verification of their identity and of all information on the entry form.

    Likewise, failure to comply with these rules, as well as any fraud or attempted cheating, whatever the method, will result in the pure and simple elimination of the author's participation.

    ARTICLE 7 - MODIFICATION OF THE GAME DATES AND EXTENSION OF THE NUMBER OF PRIZES

    The organizing company may not be held liable in the event of force majeure or events beyond its control if it is forced to cancel the present Contest. It also reserves the right to extend or limit the participation period, to postpone or modify the conditions, and cannot be held liable in any way whatsoever.

    Additions and amendments to these rules may be published during the Game. They will be considered as annexes to the present rules.

    ARTICLE 8 - USE OF WINNERS' IDENTITIES

    Your personal data is processed by Cave du Roi Dagobert, acting as recipient and data controller, in accordance with European and French data protection regulations.

    The Data Protection Officer (DPO) can be contacted at caveau@cave-dagobert.com.

    By participating in the Game, you consent to the processing and collection of your personal data. The personal data collected is mandatory. If you do not provide the required data, you will not be able to participate in the Game.

    It will be used exclusively by Cave du Roi Dagobert for the sole purpose of registering your participation in the Game, managing the winners, awarding prizes and meeting legal and regulatory obligations. Your data may also be used for commercial prospecting purposes, subject to your consent.

    Your personal data is transferred to our marketing and communication departments, as well as to service providers and subcontractors that Cave du Roi Dagobert may call upon for the purposes of organizing and/or managing the Game. These subcontractors are located in the European Union.

    Your personal data will be immediately deleted once the game has ended or will be kept for a maximum of 3 years if you have agreed to the use of your data for commercial prospecting purposes. This period may be extended in the event of litigation in order to protect our interests.

    You may withdraw your consent at any time.

    You have rights of access, rectification, deletion and portability of your data, limitation and opposition to the processing of your data, as well as the right to define directives concerning the fate of your personal data after your death. To exercise these rights, please send your request to caveau@cave-dagobert.com. You also have the right to lodge a complaint with the French Data Protection Authority (Commission Nationale Informatique et Libertés).

    ARTICLE 9 - REIMBURSEMENT OF PARTICIPATION FEES

    On request, any participant may be reimbursed for the estimated time taken to play the Game from a landline telephone, excluding mobile participation, on the basis of a 3-minute connection at a reduced rate.

    The request for reimbursement must be sent to the following address: Cave du Roi Dagobert, 1 route de Scharrach, 67310 TRAENHEIM, accompanied by a bank details form and a detailed invoice in the participant's name, indicating the date and time of the connection and the exact nature of the service provided by the Internet service provider and its billing method (unlimited, flat-rate) no later than fifteen (15) days after the close of the Game, as evidenced by the postmark.

    The costs incurred by the participant for the postage necessary for this request will be reimbursed on simple written request on the basis of the slow "letter" rate in force. Only one reimbursement request per participant registered for the Game and per envelope (same name(s), same address). Incomplete requests will not be considered.

    Given the current state of services and technology, some Internet service providers offer a free or flat-rate connection to Internet users, it is expressly agreed that any access to the site on a free or flat-rate basis will not give rise to any reimbursement, insofar as the subscription to the services of the service provider is in this case contracted by the Internet user for his or her use of the Internet in general, and the fact that the participant connects to the site and participates in the Game does not incur any additional costs or disbursements.

    ARTICLE 10 - LIABILITY

    Participation implies knowledge and acceptance of the characteristics and limits of the Internet, the lack of protection of certain data against possible misappropriation or piracy, and the risk of contamination by any viruses circulating on the network. La Cave du Roi Dagobert declines all direct or indirect liability in the event of misuse or incident related to the use of the computer, access to the Internet, maintenance or malfunction of the Game servers, the telephone line or any other technical connection, or the sending of forms to an incorrect or incomplete address.

    It is the responsibility of all participants to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any attack.

    La Cave du Roi Dagobert will do its utmost to provide access to the Game. It may at any time, in particular for technical, updating or maintenance reasons, interrupt access to the site and the Game. La Cave du Roi Dagobert shall not be held liable for any such interruptions or their consequences. No compensation may be claimed in this respect.

    In addition, Cave du Roi Dagobert cannot be held liable in the event of problems with the delivery or loss of postal or electronic mail (particularly with regard to the delivery of prizes). Any prize sent by La Cave du Roi Dagobert to a winner that is unclaimed or returned for any other reason by the postal services will be lost for the winner and will remain the property of La Cave du Roi Dagobert. La Cave du Roi Dagobert cannot be held responsible for Internet network malfunction, nor for delays, loss or damage resulting from postal and management services.

    ARTICLE 11 - INTELLECTUAL, LITERARY AND ARTISTIC PROPERTY RIGHTS

    The images used on the Game site, the objects depicted, the trademarks and trade names mentioned, the graphic elements, data processing and databases making up the Game site are the exclusive property of their respective owners and may not be extracted, reproduced or used without the written authorization of the latter, under penalty of civil and/or criminal prosecution.

    ARTICLE 12 - PERSONAL DATA

    The personal data collected will be used solely for the organization of the Game. The data collected will be kept until the winners have been designated, after which it will be destroyed.

    Participants are informed that when they access the Game site, a cookie may be stored on their computer's hard drive. Participants may prevent this cookie from being stored, or choose to be notified when a cookie is stored on their hard drive, by configuring their browser software.

    In accordance with the French Data Protection Act of January 6, 1978, as amended, and European Regulation 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data, you have the right to access and rectify information concerning you, as well as the right to object, to limit processing and to erasure within the framework permitted by the European Regulation.

    ARTICLE 13 - JURISDICTION AND INTERPRETATION OF THE REGULATIONS

    Any dispute concerning the interpretation of these rules will be settled by Cave du Roi Dagobert. Participation in this Game implies unreserved acceptance of the present rules in all their stipulations, the ethical rules in force on the Internet and the laws and regulations in force on French territory, in particular the provisions applicable to games and lotteries in force. No telephone or written request concerning the implication or application of the present rules, the mechanisms or terms of the Game or the list of winners will be answered. In the event of a dispute, only a registered letter with acknowledgement of receipt sent within 30 days of the end of the Contest will be accepted. Except in the case of obvious errors, it is agreed that the information resulting from the game systems of the Cave du Roi Dagobert has probative force in any dispute as to the elements of connection and computer processing of said information relating to the Game.

    Prior to any legal action related to or in connection with the present rules (in particular their application and interpretation), participants undertake to make an amicable and free-of-charge appeal to the Cave du Roi Dagobert.

    Participants are subject to French regulations applicable to games and competitions.
